El Derecho Penal Internacional como conjunto de normas que regulan la responsabilidad penal individual por violaciones graves al derecho internacional, implica, en el ámbito de la CPI, el juicio y la condena, en caso de proceder, por la comisión de crímenes de genocidio, lesa humanidad, guerra y agresión. La práctica del referido tribunal, establecido para juzgar las situaciones más graves y trascendentes, implica en algunos casos la investigación y juicio de delitos de carácter masivo, es decir, que involucran una gran cantidad de víctimas o de delitos cometidos. En esta medida, las dificultades que se presentan en el área probatoria son importantes, especialmente en los campos de la cooperación judicial internacional y en la barrera que impone el estándar de la duda razonable y su relación con el principio de presunción de inocencia; algo que no ha obstado para que la CPI haya emitido su primera condena en la historia en el caso “the Prosecutor vs. Thomas Lubanga Dyilo”, de especial relevancia para el presente artículo.
The International Criminal Law as a compendium of laws that regulate the individual criminal responsibility for severe violations to the international law, it is responsible in the jurisdiction of the International Criminal Court, the trial and sentence, in case to proceed, due to committing crimes of genocide, crimes against humanity, war and aggression. The practice of the mentioned court, established to judge the most severe and transcendent situations, implies that in some cases the investigation and trial of crimes of massive nature, in other words, that involve a vast amount of victims or crimes committed. In this order of ideas, the difficulties regarding the probative area are significant, especially in the areas of international judicial cooperation and the barrier that the standard of the reasonable doubt imposes and its relationship with the principle of presumption of innocence; something that has not prevent the International Criminal Court to deliver its first sentence in history in the case “The Prosecutor vs. Thomas Lubanga Dyilo”, of special relevance for the present article.
