dc.descriptionThe historiography of the medicalization of justice in Antioquia can be understood as a case of epistemic injustice, as it tends to marginalize technical knowledge within the judicial context. Historical studies on medicalization in Colombia suggest that this process permeated various spheres, including law and the administration of justice, privileging, since the late nineteenth century, the role of the government-appointed physician over other types of experts. This article argues that such historiographical interpretation enacts a form of epistemic injustice by making alternative forms of knowledge invisible; particularly, that of midwives-experts. The latter are understood as subjects of knowledge, as they produce, share, and adapt specific technical-cultural knowledge. This article contrasts the historiographical narrative with the contemporary legislation, the legal doctrine, and judicial cases recorded in the 1930s and 1940s. From this analysis, it explores, theoretically and conceptually, how midwives’ knowledge is structured and why its exclusion constitutes a case of testimonial injustice. Finally, it highlights the importance of technical knowledge in judicial practice and its relevance for a critical reflection in the field of historiography. © 2025 Elsevier B.V., All rights reserved.
