La tendencia actual y moderna del derecho administrativo, es la de considerar que la administración en todas sus actuaciones está regida por la Constitución y las Leyes del Estado, las cuales son promulgadas con el objetivo de garantizar los derechos fundamentales de su población, y a su vez, las obligaciones de los administrados frente al Estado mismo. Sin embargo, existe un espectro situacional, que permite a la administración adoptar decisiones por fuera del marco legal (principio de legalidad), apartándose del eje central previsto por las normas. Esta especial situación, solamente obedece a aspectos tales como: la necesidad y la proporcionalidad; pero en ocasiones, puede llegar a establecer y determinar actuaciones ilegales y abusivas en perjuicio de los derechos de los destinatarios de la decisión discrecional. Con todo, estudiaremos las principales consecuencias y el efecto jurídico de adoptar decisiones discrecionales por parte de la administración en los procedimientos contractuales, especialmente en la Licitación pública para la contratación de los pasaportes 2023 en Colombia, y si estas decisiones contravienen o no el principio de legalidad previsto en la Constitución y la Ley.
The current and modern trend of administrative law is to consider that the administration in all its actions is governed by the Constitution and the Laws of the State, which are promulgated with the objective of guaranteeing the fundamental rights of its population, and to its time, the obligations of those administered to the State itself. However, there is a situational spectrum that allows the administration to make decisions outside the legal framework (principle of legality), departing from the central axis provided for by the regulations. This special situation is only due to aspects such as: necessity and proportionality; but on occasions, it can establish and determine illegal and abusive actions to the detriment of the rights of the recipients of the discretionary decision. However, we will study the main consequences and legal effect of adopting discretionary decisions by the administration in contractual procedures, especially in the public tender for the contracting of 2023 passports in Colombia, and whether or not these decisions contravene the principle of legality provided for in the Constitution and the Law.
