In the present work of degree is studied the policy of legal banking from the theoretical proposal of the Austrian School, and that seeks to provide a possible solution to the economic cycles of recession and crisis facing the market economy. Through a solid formulation in economic and legal theory is intended to show the failures of banking throughout history, and how through the artificial expansion of credit macroeconomic imbalances occur. Chapter 1, configures the structure and functioning of the Colombian financial system, with the purpose of allowing the reader to identify the institutional framework that comprises it, and to review the behavior of some macroeconomic variables related to the banking and financial sector. In chapter 2, the reserve is studied as monetary policy, where a historical view of the banking reserve, its development, application and effects at a national and international level is given. In chapter 3, the whole theoretical proposal of the Austrian School is developed, where the role of money, bank credit, monetary policy, legal analysis and economic cycles are related. A proposal to reform the current banking system at an international level is presented, which aims to stabilize the world economy.
