Resumen
The main objective of the research is to reveal the scenario of the legal treatment given to abortion in Brazil in the light of women’s right to self-determination. The work will be approached from the hypothetical-deductive and dialectical methodologies, through the comparative, historical, statistical and monographic techniques, through bibliographic, documentary methods, having as a source of primary analysis a case study on the most recent decisions made by Supreme Federal Court regarding the issue of termination of pregnancy. As a result, the present work identified a certain advance in the debate about women’s rights in the social and legal scenarios, although these were not sufficient to support the right to terminate a woman’s pregnancy in the first trimester of pregnancy in a definitive way. The work concludes that the Brazilian socio-juridical panorama is still permeated by conservative views, which need to be properly fought in order for there to be an effective female conquest to expand the chances of legal abortion.
