Guía para la restitución internacional de menores en Colombia en la ley 1098 de 2006

Abstract

This paper analyzes the operation of the Inter-American Convention on International Return of Minors Act 880 of 2004, Act 173 of 1994 and the Convention on Civil Aspects of International Child Abduction 1980. The analysis identified the difficulties that have been occurring in Colombia with the implementation of the Inter-American Convention on the International Return of Children. Therefore projects a methodological guide for the international return of children in Colombia according to Law 1098 of 2006-Code for Children and Adolescents and other related provisions, as a solution aimed at guaranteeing the rights of children and adolescents have a family and not be separated from it. The research was an analytical and descriptive standards and case law that allowed gaps clarify regulations on the procedure for securing the international return of children and adolescents with the primary goal of ensuring basic rights for sustained prevalent harmonious, to grow within a family in an atmosphere of happiness, love and understanding.
