El derecho de daños ha ido incursionando al interior de las relaciones de familia para permitir la indemnización integral de los perjuicios causados en ese contexto, entre los cuales, se destacan los daños sufridos por los hijos como consecuencia de la impugnación de paternidad, cuando el reconociente actuó con culpa porque conocía que no ostentaba dicho rol y de allí se infligen agravios para el descendiente que no estaba obligado a soportarlos. En ese escenario, una vez la sentencia que extinga el vínculo quede ejecutoriada, el ofendido podrá acudir ante el juez civil y allá proponer el proceso declarativo respectivo.
Tort law has been making inroads into family relationships to allow for full compensation for harm caused in this context. Among these, the most notable are harm suffered by children because of contested paternity, when the acknowledging party acted negligently because they knew they did not hold that role, and thus inflicted harm on the offspring, who were not obligated to bear them. In this scenario, once the judgment terminating the relationship becomes final, the injured party may go before a civil judge and there file a declaratory judgment.
