Para enfrentar una serie de situaciones internacionales conflictivas, de las cuales no se sabe cuáles son sus verdaderas dimensiones, se ha asumido por parte del derecho penal internacional una huída hacia el poder punitivo, por medio del Estatuto de Roma o Corte Penal internacional. Tal poder, al contrario de lo que sucede a nivel local, parece carecer de límites o en caso de tenerlos se hallan minimizados. Lo anterior, convierte al derecho penal internacional en una expresión de autoritarismo, como lo fue en su momento en Malleus Maleficarum. Frente a ello debe plantearse un discurso jurídico penal limitador que, alejado de aquel poder, le establezca límites para propender por la vigencia real de los derechos humanos.
Addressing a number of international conflicts, from which no one knows its true dimensions, it has been assumed by the international criminal law through the international punitive power in its Rome Statute or its International Criminal Court. Such power is above to local law, which seems to have no limits whatsoever. This makes International criminal law the highest expression of authoritarianism, as it was once at the Malleus Maleficarum. Against that should be proposed criminal law limits. There should be limits for tending towards genuine observance of human rights.
