Este artículo tiene como objetivo central demostrar, a partir de las nociones de protección del ambiente y de contrato, con especial referencia al derecho positivo colombiano, que las principales teorías existentes en derecho de contratos, de alguna u otra forma han hecho aportes importantes en cuanto a las implicaciones ecológicas del contrato, pero que ninguna ha tenido ese como su objeto central de estudio, por lo cual es necesario, para efectos de estudiar la protección del ambiente en la contratación mercantil en Colombia, acudir a una teoría distinta a las del derecho de contratos
The main point of this article to demonstrate, from the notions of environment and contract protection –especially reflated to positive Colombian Law, that the main exiting theories in contract law, in a way or the other, have made important contributions related to ecological implications of a contract, but that no one hashad this as its main object of study; therefore, it is necessary, in order to study the protection of the environment in mercantile contracts Colombia, to resort to a theory different from the contract law.
