Las reformas procesales del último siglo se fundamentaron en una nueva perspectiva: la tendencia publicista del proceso –incluido el proceso civil, que por tradición se había estudiado como privado–, lo cual lleva a un Juez director del proceso. Un vértice interesante por abordar a partir de estas nuevas tendencias, corresponde a los límites que tiene el Juez en el desarrollo de los poderes de oficio que puede desplegarsobre la prueba. Esta es la idea que se presenta en este trabajo: de dónde surgen los límites a los poderes de oficio y cómo se sustentan estos límites en el derecho contemporáneo.
Procedural reforms of the last century were based on a new perspective: the advertising tendency of the process, including the civil process that has been always studied as private, which involves a Judge as the process manager. An interesting issue to tackle, based on these new trends, is the limits of the Judge in the development of its court-appointed powers, which can be displayed on the evidence. The objective of this report is to present the idea: Where the limits of the court-appointed powers come up and how they are supported in the contemporary law.
