Este trabalho é uma análise de parte do livro “Soberania, representação, democracia: Ensaios de história do pensamento jurídico”, do professor florentino Pietro Costa. São reflexões, a partir da história que narra esta obra, sobre as tensões entre a vontade (o poder) e a razão (os direitos do sujeito) e sobre os fracassos das múltiplas teorias propostas para evitar os efeitos negativos de tal tensão. Assim, expõe-se o trajeto do Estado liberal de Direito (com seu estatismo e legicentrismo) ao Estado Constitucional, que é o trajeto de um demos soberano, formado por maiorias, a um demos entendido como sociedade pluralista.
This paper discusses part of Florentian Professor Pietro Costa’s book “Soberania, representação, democracia: Ensaios de história do pensamento jurídico”. It reflects, from the story Costa tells in his work, about the tensions between Voluntas (power) and Ratio (subject’s rights) and about the failures of the many theories proposed in order to prevent the negative effects of such tension.Thus, this paper shows the way from liberal State (with its statelism and law-centrism) to Constitutional State, which is the way of a sovereign demos, made by majorities to a demos understood as pluralistic society.
