La determinación de las diferencias entre principios y valores se constituye en una condición necesaria para el desarrollo del control de constitucionalidad y posterior fortalecimiento del Estado social y constitucional de derecho. En este trabajo se expone lo que la Corte Constitucional, en la jurisprudencia elaborada desde 1991, ha entendido por principios y valores. Se demostrará a través del estudio de la noción de principios constitucionales, valores jurídicos y valores superiores, la inexistencia de una línea jurisprudencial que dé explicación clara y coherente sobre su naturaleza y funciones. La investigación es de tipo documental y analítico, la cual tiene por base las decisiones adoptadas por esa alta corporación.
The determination of the differences between principles and values is a necessary condition for the development of judicial review and subsequent strengthening of the social and constitutional law. This paper sets out what the Constitutional Court in the case law developed since 1991, understood by principles and values. The inexistence of a line of jurisprudence giving a clear and coherent explanation of its nature and functions will be demonstrated through the study of the concepts of constitutional principles, legal values and higher values. The research is documentary and analytical, and it bases its decisions on those adopted by such high corporation
