Este trabajo es un análisis de un apartado del libro “Soberania, representação, democracia: Ensaios de história do pensamento jurídico” (Curitiba, Brasil, Juruá Editora, 2010) del profesor fl orentino Pietro COSTA. Se comenta y, a la vez, se reflexiona, la historia que narra esta obra, de un lado, sobre las tensiones entre la voluntad (poder) y la razón (los derechos del sujeto) y, del otro, sobre los fracasos de las múltiples teorías propuestas para evitar los efectos negativos de dicha tensión. Así, se expone el paso del Estado liberal del Derecho (con su estatalismo y legicentrismo) al Estado Constitucional, que es el paso de un demos soberano conformado por mayorías a un demos entendido como sociedad pluralista.
This paper is an analysis of a chapter of the book “Soberania, representação, democracia: Ensaios de história do pensamento jurídico” (Curitiba, Brasil, Juruá Editor, 2010) from Florence’s professor Pietro COSTA. This paper comment and refl ects the story that COSTA tells in his work, from one side, about the tensions between Voluntas (power) and Ratio (rights of subject) and, on the other, about the failures of the many theories proposals to prevent the negative effects of such tension. Thus, this paper exposes the passage of the liberal State of law (with its statelism and law-centrism) to the constitutional State, which is the passage of a sovereign demos shaped by majorities to a demos understood as pluralistic society.
