Abstract

The purpose of this research is to analyze the scope of application of the Theory of Dynamic Load Test on the principle of presumption of innocence (Article 7 of Law 906 of 2004), in accordance with the interpretation given by the Criminal Appellate Division of the Supreme Court; for it is part of the studied application of the Theory of Dynamic Burden of Proof in Criminal Proceedings from Colombian doctrine, legislation and jurisprudence; then the relationship between the "burden of proof" and moderate adversarial system of Act 906 of 2004 is identified; and finally is evaluated from the jurisprudence of the Supreme Court Criminal Appeals Chamber, the implications of the application of the Theory of Dynamic Load Test on the principle of presumption of innocence.
