Este artículo analiza las obligaciones que tiene el Estado Colombiano de investigar, sancionar y juzgar las ejecuciones extrajudiciales cometidas por sus agentes o con su complicidad, a la luz de las normas internacionales, especialmente del Sistema Interamericano de Derechos Humanos. Lo anterior, a través del estudio de caso del señor, Víctor Manuel Hilarión, quien ejercía su rol de liderazgo comunitario en la zona rural de la región de Sumapaz; el cual, llegó a conocimiento de la Corte Interamericana de Derechos Humanos, en la búsqueda de justicia. El artículo es resultado de una investigación cualitativa, que se desarrolló a través de la revisión de normas, jurisprudencia y doctrina del Derecho Internacional de los Derechos Humanos. Los resultados del análisis en el caso de estudio muestran la insuficiencia del ordenamiento jurídico nacional, y los desafíos que enfrentan las víctimas para obtener justicia en casos de graves violaciones a los Derechos Humanos e infracciones al Derecho Internacional Humanitario, como lo son las ejecuciones extrajudiciales y el homicidio de persona protegida. Lo anterior, de cara a la construcción de un precedente jurisprudencial que permita la puesta en marcha de una ruta para el acceso a la justicia ante el Sistema Interamericano de Derechos Humanos.
This article examines the obligations of the Colombian State to investigate, sanction, and prosecute extrajudicial executions committed by its agents or with their complicity, in light of the norms of the Inter-American Human Rights System. This is done through the case study of Mr. Víctor Manuel Hilarión, who held a leadership role in the rural area of the Sumapaz region; a case that was brought before the Inter-American Court of Human Rights in the pursuit of justice. The article is the result of qualitative research conducted through the review of norms, jurisprudence, and doctrine of International Human Rights Law. The findings of the case study analysis reveal the insufficiency of the national legal framework, and the challenges faced by victims in obtaining justice in cases of serious human rights violations and breaches of International Humanitarian Law, such as extrajudicial executions and the homicide of protected persons. This, in turn, highlights the importance of establishing a judicial precedent that enables the implementation of a pathway for access to justice before the Inter-American Human Rights System.
