Resumen

Descripción

The article explores the impact of emerging technologies, such as artificial intelligence (AI), on the judicial process, emphasizing the representative vision of the “digital judge” and its potential to transform the administration of justice. Using an analytical-descriptive approach, framed in a qualitative methodology, it examines how the integration of AI affects the application of fundamental principles of law and the operation of the judicial system. The discussion begins with the constitutionalization of law in the digital age, leading to an approach to the concept of digital judge. Finally, the article addresses the use of the PretorIA system in the Constitutional Court of Colombia. By determining that PretorIA represents a type of digital judge known as “decision support tools”, the article suggests that AI will serve as a facilitator of justice, by quickly locating and providing legally relevant information to the judicial operators thanks to technologies such as big data or blockchains, which enhance the efficiency of the judicial system. Thus, the article highlights the importance of using new technologies in the digital age while acknowledging the potential risks, such as those posed by generative AI. Through this analysis, the article aims to contribute to the debate on the configuration of a judicial system that upholds the principles of justice, equity, and due process in the digital age. © 2024, Universidad Catolica de Colombia.
